To be fair, the case itself has not been litigated yet. The issue here was simply regarding a preliminary injunction. Jacobsen may have come to the realization that he was not going to get an injunction without spending far more money than he had in his pocket. If/when the case goes to trial and judgement, there will be a lot more to say.
