Sure, I was just explaining why I thought "broken" a bit harsh as a
verdict.

On the other hand, the time explaining this would be better spent
changing it, anyway.  Does cp -pr on BSD as well as System 5 do
everything cp -a does here, more or less?  We need not worry about
symbolic links, I guess.
