I guess one could. Depends on whether that image replaces the entire
contents, or just some small portion. From a legal standpoint (assuming
Atmel cares at all), disassembling code might be construed as copyright
infringement, whereas reverse engineering by sniffing the signals isn't.
Pure speculation, and just something we *may* want to keep in the back of
our minds.
Of course, this problem would be a little easier if Atmel would just
exhibit some common sense like everyone else that supports JTAG, and release
the relevant commands. I *personally* care little little about the
debugging commands, but care a lot about the programming sequences. But
then, I debug the old fashioned way, with printf() and I/O bits. I've
always found gdb to be extremely cumbersome.

is it not possible to dissasemble the JTAGICE firmware? Or what kind of file
is the Upgrade.ebn? As I see in my JTAGICE a normal ATmeg163 is inside.
