Because POSIX requires the current behavior. It says:
If a file is created, the file's
permission bits shall be set to S_IRUSR | S_IWUSR.
But if you create the file first
(e.g. `rm -f nohup.out; touch nohup.out'),
nohup will be happy to append to it without changing
the umask-derived permissions.
