I also believe this behavior is intentionally like this. I certainly do not remember, but I think the best answer will be provided by Jørn.

What could be the point of this behaviour ? Shouldn't the Jacoby rule
always be ignored in cubeless play ?

The way this is documented suggests this is a choice, not an oversight.
Does anyone who has been following gnubg's development for long enough
remember why it is done this way ?
