I am so sorry. As I had already said (7 weeks ago) this is clearly
correct and I introduced the original buggy code. I have finally checked
this in.

This is all the more embarrassing since there was a huge thread on
exactly this method on the classpath mailinglist about which exception
to throw from this method but nobody seemed to have noticed that the
actual method contained this huge bug. My sincere and double apologies.
