Follow-up Comment #1:

a) it cannot be a background error, since the front end checks for the
particle existence. It can only be a normal Tcl error.

b) that would break many existing scripts, which check for na, including some
of the Tcl functionality like writing pdbs.

c) that was intended behavior

Therefore, I would postpone this discussion till we switch to Python, where we
can think of a new interface.
