[Fsfe-france] Une société française du libre aurait déposé des brevets logiciels

Voici une info très intéressante relevée par un lecteur de Linuxfr
(http://linuxfr.org/~ccomb/12658.html).

Le site Web du logiciel libre "ERP5" affirme avoir déposé des brevets
logiciels sur des algorithmes ou idées utilisées par ERP5. Il semblerait
que le projet "ERP5" soit piloté par la société Nexedi SARL, comme en
attestent notamment les liens du haut de page et divers communiqués ou
dépêches trouvés via Google.

patents and trademarks. ERP5 copyright is licensed under the terms of
either the GPL (programmes), GFDL (documentation) or GPDL (collections

[je souligne la dernière phrase, qui affirme l'existence de brevets -
forcément logiciels - déposés sur ERP5]

Chacun jugera de la justification avancée sur le site de Nexedi, qui
explique son intention de déposer des brevets logiciels :

      * defensive measure: in the event software patents become
        enforceable in Europe and a competitor tries to use patents to
        prevent Nexedi from doing business or to prevent the ERP5
        community from developping ERP5, Nexedi will give away its
        patents to whoever can attack this competitor.
      * fiscal optimisation: our competitors use software patents to
        increase their profitability. For example, Ireland is used as a
        hub by US software companies to evade corporate taxes through
        patent licenses. Some EU companies use software patents to
        reduce corporate taxes during acquisition / merger operations.
        Patents are considered as long term asset and benefit from
        special fiscal Laws. This creates a strong incentive to account
        software R&D through patents rather than through copyright.
        Until software R&D fiscal Law gets harmonized and until
        accountants get used to consider copyright as a valuable asset,
        Nexedi must follow the same practices as its competitors. »

L'argument sur la fiscalité, qui ressemble à celui souvent avancé pour
justifier les délocalisations (afin d'être compétitif, « Nexedi se doit
d'utiliser les mêmes pratiques que ses concurrents »), avait fait
l'objet d'une conférence de Jean-Paul Smets, créateur de Nexedi, lors
des Rencontres Mondiales du Logiciel Libre (Libre Software Meeting) en 
2002 à Bordeaux.
