Well, it could be said to be at both.

If the server isn't implementing something the RFC says is mandatory, 
that's a problem.

That said, the advice when coding up RFC implementations has always been 
(paraphrased) "Be tolerant in what you accept, strict in what you send."  
Obviously some clients work on the server, so it's possible, and pan 
could be considerably more tolerant of what currently simply assumes is 
an implemented command, accepting non-compliant implementations and 
working around them using other commands as other clients obviously do.
