It is definitely fair to tune against an available opponent,
independent of the GPL. This is traditional in computer
chess and Go.
It seems likely that since GNU Go and Go Intellect
have been closely matched in recent tournaments that
Ken Chen would have wanted to tune against GNU Go,
especially if he is improving his program.
