OpenBSD (4.7-current at least) should drop files if -E parameter is used:
-E, --remove-empty-files
Causes patch to remove output files that are empty after the
patches have been applied. This option is useful when applying
patches that create or remove files.
GNU patch (tested on Debian) should support -E also.
